Mandatory Renewal of the Employer Registration Certificate

Mexican companies that hire foreign talent must be aware of the mandatory annual renewal of the Employer Registration Certificate (“Constancia”) before the National Institute of Migration (“INM”). This obligation applies regardless of the registration date or the last renewal and must be completed in April, once the annual tax return for the previous fiscal year has been submitted to the Tax Administration Service (“SAT”), no later than March 31, 2025.

Additional Employer Obligations

 

In addition to the annual renewal, companies must notify the INM of any modifications to their structure or relevant information, such as:

 

  • Change of legal representatives
  • Modification of the registered corporate address
  • Opening or closing of branches
  • Change of corporate name or tax status
  • Update of the Federal Taxpayer Registry (RFC)
  • Adjustments to the corporate purpose or REPSE registration (if applicable)

  • They will lose the ability to sponsor temporary or permanent residence for their workers
  • They won’t be able to process residence renewals or other immigration procedures

The estimated processing time for updating the Certificate ranges from one to five weeks, depending on the INM delegation handling the request.
